Course goal

Develop an understanding of the global export control system among the organization's personnel and develop skills to implement export control processes accompanying the company's foreign economic activity, as well as to develop independently a new or modernize the current export control system at the enterprise.

Course objectives

• Develop personnel skills to implement export control processes: developing provisions of contracts (revenue) and agreements (expense) taking into account export control rules, initial identification of goods and services, preparing an application for obtaining (renewal / termination) an authorization document in the FSTEC of Russia or IIC; for the personnel of Rosatom State Corporation (additionally): execution of an application to the Export Council of Rosatom State Corporation for examination of a foreign economic transaction within the framework of a draft contract and to the Contracting Committee of Rosatom State Corporation for approval of the draft foreign economic contract.
• Develop an understanding of the entire chain of export control processes within the framework of a foreign economic transaction (modules for industry and non-industry organizations are different, see the course outline).

Course description

The course "Export Control" is implemented within the framework of the Foreign Economic Activity Specialist Training Program and is a composite modular distance learning course.

The "Foreign Economic Activity Specialist" personnel training program is a set of educational thematic courses to improve the qualifications of personnel involved in the implementation of foreign economic activity. The training program includes the following courses:

• Export control;
• International transport logistics;
• Customs clearance;
• Legal support of FEA and opening of branches and subsidiaries and affiliates;
• Currency control;
• Business planning.

Foreign economic activity with controlled goods and technologies requires compliance with national and industry-specific export control requirements. Personnel in an organization may have a good understanding of the company's internal export control processes, but lack a global understanding of the export control system (at the national and international level): its elements and participants, the mechanisms of the system, and the tools for changing the system. Failure to understand the global export control system leads to lengthy onboarding of new employees and employees with experience with significant changes in an organization's internal export control processes, as well as increased risk of export control violations and subsequent civil, administrative, and even criminal penalties for the company and management personnel.

Completion of the EC course will allow specialists implementing foreign economic activity processes to plan correctly the processes of foreign economic transactions taking into account the EC procedures, to mitigate the risks of administrative and criminal violations in the field of export control, to implement effectively the export control processes in the area of their responsibility.

Due to its modular structure, the course is intended for several categories of trainees:

• New employees of the organization with no experience in implementing foreign economic activities
• Existing employees of the organization who implement foreign economic activities and need a deeper understanding of the entire cycle of supporting processes for foreign economic activity (including export control processes)

Goals and objectives of the training

• Understand the basic objectives and principles of supply management, knowledge of terminology. Understand the main parameters of transportation efficiency: cost, time, cargo safety, risks. Know the current transport corridors.
• Know and understand the sequence of operations for delivery of goods.
• Understand the roles and responsibilities of participants in the delivery process depending on the delivery basis (Incoterms 2020)
• Know the content of transportation and TEA contracts, understand the difference, analyze the terms of the contract
• Know the composition and methods of information exchange, familiarize with carrier information systems
• Ability to formulate a transportation request
• Understand the specifics of cargo transportation by sea, road, air and rail. Ability to analyze the feasibility of using a particular mode of transportation or combination of modes depending on the situation and tasks.
• Know the types of containers and the specifics of their use.
• Know the main provisions of conventions and agreements governing transportation by individual modes of transport and intermodal transportation.
• Understand the structure of a foreign trade contract, be able to find and analyze the transportation component. Know and understand the responsibilities of the parties in all Incoterms 2020 delivery terms. Be able to calculate shipping costs for different delivery terms.
• Know the composition of the package of documents for transportation by different transport, be able to analyze the information presented in the documents and identify errors.
• Understand the principles of multimodal transportation. Know the composition of FIATA documents. Be able to analyze the information presented in documents
• Understand the principles and methods of customs regulation. Know the composition and structure of customs regulations
• Understand the requirements and restrictions of customs transit. Know and be able to analyze the composition of information contained in the transit declaration.
• Know the composition of customs procedures. Understand the impact of the transaction on product delivery operations
• Classify goods for customs purposes.
• Determine customs value, understand the structure of customs value. Be able to document the customs value.
• Know the types of prohibitions and restrictions and the forms of documents to overcome them
• Know the forms of customs control, rights and obligations of participants in the process of delivery of goods
• Know the types of offenses.

Course description

ITL (international transport logistics) course training will provide the trainee with a set of knowledge, skills and abilities that will allow specialists implementing foreign economic activity processes to plan correctly the processes of foreign economic transactions implementation taking into account logistics procedures, to build effectively logistics processes during the whole cycle of goods delivery, to formulate correctly and comprehensively the terms and conditions of foreign economic contracts, to determine the terms and conditions of cargo deliveries taking into account the territorial location of the customer.

Goals and objectives of the training

• Understand the role of customs regulation in the full cycle of a foreign economic transaction, the role of the delivery manager in this process, their duties and areas of responsibility, customs clearance of goods in cross-border movement of goods, the role in the processes of cross-border movement of goods (control and preparation by the manager in charge of the supporting documents project for the person in charge), areas of responsibility, duties and targets
• Understand the basics of legal and economic regulation of FEA in the world
• Understand the basics of international regulation of customs procedures
• Understand the structure and functioning of the EAEU bodies
• Know and understand the principles of organization and legal basis of customs affairs, the structure of customs authorities of the Russian Federation, their goals and objectives
• Understand the principles and methods of customs regulation. Be able to correlate current and potential actions of regulatory authorities with the principles and methods of customs regulation
• Understand the relationship between export control and customs clearance of goods (system of prohibitions and restrictions, documents required for cross-border transfer and customs clearance of goods, customs declarations, radiation safety requirements, etc.).
• Understand how the transport selection can affect the speed of customs clearance of goods, the required set of documents, and the peculiarities of such clearance.
• Plan deliveries taking into account customs clearance processes
• Be able to plan the complete delivery cycle taking into account customs clearance processes.
• Be able to mitigate the risks of delayed delivery dates

Course description

CC (customs clearance) course training will provide the trainee with a set of knowledge, skills and abilities, which will allow specialists, implementing the processes of foreign economic activity, to master the necessary level of theoretical knowledge and practical skills in customs clearance, understanding of work with customs authorities, customs representatives, carriers, which will significantly accelerate the process of passing customs control, legally reduce the necessary customs payments.

• Understand customs inspections prior to release.
• Understand desk and field customs inspections.
• Understand the interaction of Customs with other agencies.
• Understand the interaction between the company and the customs authority within the framework of inspections.
• Understand appeals against decisions of customs authorities.
• Evaluate the consequences of customs audits.
• Know and understand post-verification processes.
• Understand the problems of including license fees in the customs value of imported goods.
• Know the procedure for confirming the amounts of transportation costs as part of the customs value of relocated goods.
• Understand processing in the customs territory: implementation procedures and important practical points of application.

The CR (customs regulation) course training will provide the trainee with a set of knowledge, skills and abilities, which will allow specialists implementing FEA processes to get acquainted with the best practices in the field of customs regulation, real cases of challenging court decisions, analysis of approaches to interaction with customs authorities, as well as recommendations for management decisions.

The CC course training will provide the trainee with a set of knowledge, skills and abilities, which will allow specialists implementing FEA processes to master the conceptual foundations of currency control and tax accounting from the position of the legal framework, the essence, content and key tools of its practical implementation, to evaluate recommendations for management decisions in connection with uncertainty and risks, when conducting FEA in the context of sanctions

Course description

The BP (business planning) course training will provide the listener with a set of knowledge, skills and abilities that will allow specialists implementing FEA processes to prepare a business plan taking into account the peculiarities of the target audience, to plan and conduct an effective presentation of the business plan, to build a coherent system of argumentation when working with the target audience and to respond to non-verbal signals of the audience when defending the business plan.

LS (legal support) course training will provide trainees with a set of knowledge, skills and abilities that will enable specialists implementing FEA processes to understand definitions of FEA law, structure of foreign economic contracts with recommendations on contract provisions, including aspects of currency and customs legislation, as well as to assess arbitration awards with recommendations on their challenge, to understand responsibility for violation of FEA legislation, including export and currency control, as well as the issues related to foreign economic activity, and to understand how to assess arbitration awards with recommendations on how to challenge them.
